Information on Potential Permanganate Shortages Due to the Carus Chemical Fire

Asset Management Program Update for Transient Non-Community Public Water Systems 

Asset management programs are no longer required for transient non-community public water systems.

On January 3, 2023, the Governor signed House Bill 364 which amends Ohio Revised Code 6109.24 that removes the asset management program requirements for transient non-community public water systems. The changes become effective on April 3, 2023, 90 days from the day he signed the bill.

With this change, transient non-community water systems will no longer be required to comply with Ohio Administrative Code Chapter 3745-87. This means they will no longer have to develop, maintain and/or implement an asset management program, or submit annual metrics data and/or be evaluated on asset management during sanitary surveys.  

However, Ohio EPA strongly encourages asset management for transient public water systems and has voluntary tools available for the development and implementation of asset management. This change only applies to the asset management requirements for transient non-community public water systems and all other requirements remain the same.

2019 Sewer and Water Rate Survey

Ohio EPA has finalized and posted the 2019 Sewer and Water Rate Survey for calendar year 2019. The purpose of the annual Sewer and Water Rate Survey is to collect and publish Ohio residential sewer and water rates. The Economic Analysis Unit annually surveys sewer and water rates charged by Ohio cities, villages and special districts during the prior calendar year. Annual rates are calculated for residential customers within municipal limits given an assumed monthly water consumption level of 7,756 gallons (or 1,037 cubic feet) per household. Rate calculations do not include charges levied through income or property taxes. Historic survey data and sewer and water rates for more than 500 cities, villages and districts during the 2003-2018 periods are available online at Ohio EPA's Office of Fiscal Administration web page.

Jan. 25, 2023: Adoption of Amended Rule Language- OAC Chapter 3745-81, Primary Drinking Water Standards Rules.

The Ohio Environmental Protection Agency, The Division of Drinking and Ground Waters (DDAGW) has rescinded the rules in Ohio Administrative Code (OAC) Chapter 3745-81.

The amended rules will go into effect on February 6, 2023. (See the Public Notice of Adoption). The rules are being adopted after a draft comment period ending on June 18th, 2022, a proposal comment period ending on November 25th, 2022, and a public hearing held virtually as well on November 30th, 2022.

Jan. 25, 2023: Rescinded Rule Language- OAC Chapter 3745-92, Financial Assurance Rules.

The Ohio Environmental Protection Agency, The Division of Drinking and Ground Waters (DDAGW) has rescinded the rules in Ohio Administrative Code (OAC) Chapter 3745-92.

The rescinded rules will go into effect on February 6, 2023. (See the Public Notice of Adoption). The rules are being rescinded after a draft comment period ending on August 12th, 2022, a proposal comment period ending on September 18th, 2022, and a public hearing held virtually as well on November 18th, 2022.

Jan. 24, 2023: The Division of Drinking and Ground Waters (DDAGW) has proposed "no changes" to Lead and Copper Rules in chapter 3745-81 of the Ohio Administrative Code (OAC) to Joint Committee on Agency Rule Review (JCARR). See the Proposed Rule page for more information.

Nov. 30, 2022: Adoption of Amended Rule Language- OAC Chapter 3745-81, Ground Water Rules.

The Ohio Environmental Protection Agency, The Division of Drinking and Ground Waters (DDAGW) has adopted the amended rules in Ohio Administrative Code (OAC) Chapter 3745-81.

The amended rules will be effective as of December 12, 2022. (See the Public Notice of Adoption). The rules are being rescinded after a draft comment period ending on February 24th, 2022, a proposal comment period ending on September 22nd, 2022, and a public hearing held virtually on September 22nd, 2022. Aug. 18, 2022: Adoption of Amended Rule Language- OAC Chapter 3745-90, Harmful Algal Blooms.

The Ohio Environmental Protection Agency, The Division of Drinking and Ground Waters (DDAGW) has adopted the amended rules in Ohio Administrative Code (OAC) Chapter 3745-90, along with the amended Ohio EPA Method 701.0 - Total (Extracellular and Intracellular) Microcystins - ADDA by ELISA Version 2.4.

The amended rules will be effective as of Tuesday, November 1, 2022. (See the Public Notice of Adoption). The rules are being adopted after a draft comment period ending on May 26, 2021, a proposal comment period ending on May 4, 2022, and a public hearing held virtually on May 4, 2022.
