The Division of Drinking and Ground Waters (DDAGW) rules were promulgated under U.S. EPA's Safe Drinking Water Act (SDWA). Rules for Ohio public drinking water systems are adopted under Ohio Revised Code (ORC) Section 6109, and rules for Underground Injection Control, under ORC 6111.043. Ohio Administrative Code (OAC) rules administered by DDAGW are located on this page. More information about DDAGW's rule-making process is available under the "DDAGW Rules Process" section below.

  • Nov. 14, 2018: DDAGW seeks comments on the draft policy document, PWS-01-003: Clarification of Public Water Systems Definition and Exemption Criteria. This document was revised to provide additional information about Public Water System Exemption Guidance, and update citations.   • Nov. 8, 2018: DDAGW has finalized the guidance documents “Asset Management Program – General Template Guidance” (OPR-07-001) and “Asset Management Program – Small Community Guidance” (OPR-08-001). These documents address compliance with the newly effective rules regarding Asset Management in Ohio Administrative Code Chapters 3745-81, 3745-87, and 3745-92.   • Nov. 1, 2018: DDAGW has finalized the guidance document Water Line Repairs and Replacements in Areas with Lead Service Lines (PWS-06-001) and addressed all comments in a formal Response to Comments. This document covers simultaneous compliance with provisions of OAC 3745-81-84 and the effective rule OAC 3745-83-02: Water distribution system disruption of service.   • Oct. 29, 2018: Ohio EPA has adopted new and amended rules governing Asset Management in Chapters 3745-81, 3745-87, and 3745-92 of the Ohio Administrative Code. The rules will be effective as of November 8, 2018 (see Public Notice of Adoption). These rules are being adopted after a draft comment period which ended on August 14, 2018, a proposal comment period which ended September 27, 2018 and a public hearing held on September 27, 2018 in Columbus, Ohio.
  • Oct. 22, 2018: Ohio EPA has adopted a new rule governing water distribution system disruption of service in Chapter 3745-83 of the Ohio Administrative Code. The new rules will be effective as of November 1, 2018 (see Public Notice of Adoption). The rule is being adopted after a draft comment period which ended on March 19, 2018, a proposal comment period which ended September 18, 2018 and a public hearing held on September 18, 2018 in Columbus, Ohio.
  • Oct. 16, 2018: Adoption of confidentiality of information rule: Ohio EPA has adopted the new rule governing Confidentiality of Information in Chapter 3745-34 of the Ohio Administrative Code. The revisions are a result of the five-year rule review requirements of Section 106.03 of the Revised Code (ORC).

    The new rules will be effective as of November 1, 2018 (see Public Notice of Adoption). The rules are being adopted after a draft comment period which ended on May 21, 2018, a proposal comment period which ended August 23, 2018 and a public hearing held on August 23, 2018 in Columbus, Ohio.
  • Oct. 4, 2018: DDAGW received comments on the draft guidance Water Line Repairs and Replacements in Areas with Lead Service Lines. After considering comments received, the draft has been updated. This document covers simultaneous compliance with provisions of 3745-81-84 and the proposed Disruption of Service rule. While 3745-83-02 is still a proposed rule, this guidance is currently applicable to 3745-81-84.
  • Oct. 3, 2018: DDAGW seeks comments on plan to revise Primary Drinking Water Standard rules in Chapter 3745-81 of the Ohio Administrative Code (OAC). Comments are due by November 5, 2018. Click here for more information.
  • Oct. 1, 2018: DDAGW seeks comments on plan to revise rule 3745-81-27, 3745-81-28, and rules included in Chapter 3745-89 of the Ohio Administrative Code (OAC) that set forth regulations for acquiring and retaining drinking water laboratory certification.   • Sept. 27, 2018: The Division of Drinking and Ground Waters (DDAGW) seeks comments on the CSI Business Impact Analysis form and draft amended rules in Ohio Administrative Code 3745-81 before the division formally proposes them.   • Aug. 23, 2018: DDAGW seeks comments on the draft guidance document, Water Line Repairs and Replacements in Areas with Lead Service Lines. This document was drafted in response to the new lead and copper rule, effective May 1, 2018, in chapter 3745-81 and the proposed rule governing disruption of service in chapter 3745-83 of the Administrative Code.   • Aug. 16, 2018: The Division of Drinking and Ground Waters (DDAGW) has proposed the addition of a new rule to chapter 3745- 83 of the Ohio Administrative Code to Joint Committee on Agency Rule Review (JCARR). The proposed new rule establishes requirements for public water systems that have a disruption of service involving the distribution system. Click here for more information.
  • Aug. 13, 2018: DDAGW seeks comments on plan to file Underground Injection Control rules in Ohio Administrative Code (OAC) Chapter 3745-34 with no changes. Comments are due by September 13th 2018. Click here for more information.
  • July 19, 2018: The Division of Drinking and Ground Waters (DDAGW) has proposed to rescind the current version of the confidentiality of information rule (OAC Rule 3745-34-03) and has proposed to replace the it with a new confidentiality of information rule to Joint Committee on Agency Rule Review (JCARR).   • May 29, 2018: DDAGW seeks comments on plan to revise rule 3745-91-09 of the administrative code and adopt a new rule for monitoring compliance with iron and manganese. Comments are due by July 2, 2018. Click here for more information.
  • April 12, 2018: Ohio EPA has adopted amended rules governing Primary Drinking Water Standards and the Lead and Copper rules in OAC Chapter 3745-81, Laboratory Certification rule in Chapter 3745-89 and Consumer Confidence rule in Chapter 3745-96 of the Ohio Administrative Code. The revisions were prompted by the passing of Ohio House Bill 512 which became effective in Ohio Revised Code (ORC) § 6109.121, Sept. 9, 2016.

    The new rules will be effective as of May 1, 2018 (see Public Notice of Adoption). The rules are being adopted after a draft comment period which ended March 17, 2017, a proposal comment period which ended March 6, 2018 and a public hearing held on March 6, 2018 in Columbus, Ohio.
  • Oct. 13, 2017: ​DDAGW seeks comments on the draft policy – Guidelines for Obtaining Approval of Backflow Prevention Methods in Drinking Water Treatment Plants. Click here to view the document.   • Jan. 6, 2017: DDAGW finalizes, Guidelines for Lead Mapping in Distribution Systems and Guidelines for Mapping Lead Plumbing and Fixtures for Individual Buildings. Click here to view the proposed rules and business impact analysis.
  • Jan. 3, 2017: DDAGW seeks comments on the draft guidance document, Guidelines for Determining When Source or Treatment Changes Trigger New Optimal Corrosion Control Evaluation. This document was drafted in response to the new lead and copper law, located in Ohio Revised Code Section 6109.121. DDAGW's Rule-making Process

The Division of Drinking and Ground Waters (DDAGW) rules were promulgated under U.S. EPA's Safe Drinking Water Act (SDWA). Rules for Ohio public drinking water systems are adopted under Ohio Revised Code (ORC) Section 6109, and rules for Underground Injection Control, under ORC 6111.043. Ohio Administrative Code (OAC) rules administered by DDAGW are located on this page. 

Proposing new rules and amendments to existing rules is a regular activity conducted by Ohio EPA in response to laws passed by the General Assembly and federal rule requirements. The Agency is also required by state law to review its rules at least once every five years to ensure their continued need and relevance. During the Ohio rule-making process, rules are in one of four phases: early stakeholder outreachdraftproposed; and effective. Electronic versions of rules in each of these various phases may be viewed by clicking on the appropriate tabs on this page. 

In addition to adopting rules and laws, DDAGW adopts both policies and guidance documents. The purpose of a policy is to clarify and explain specific aspects of regulations (OAC) and law (ORC) so Ohio EPA and external parties have a common understanding of how environmental regulations are carried out in Ohio. Policies promote consistency and provide savings of both technical and administrative staff resources when dealing with the application of rules. Guidance documents provide information, suggestions and recommendations on possible or acceptable methods that may be used to meet or to achieve compliance with rules.

Early Stakeholder Outreach

As of Jan. 1, 2012, Ohio EPA will conduct early stakeholder outreach in response to requirements of Executive Order 2011-01K. This outreach ensures stakeholders are brought into the rule process as early as possible.

May 29, 2018: DDAGW seeks comments on plan to revise rule 3745-91-09 of the administrative code to establish treatment requirements related to manganese in public water systems and adopt a new rule for monitoring compliance with iron and manganese. Comments are due by July 2, 2018.

Interested Party Review

Ohio EPA distributes draft rules to interested parties for review and comment before they are filed with the Ohio General Assembly's Joint Committee on Agency Rule Review (JCARR). Ohio EPA considers comments received from this preliminary review and makes changes to the rules as appropriate.

Proposed Rules

Ohio EPA considers comments received during interested party review and makes changes to the rules as appropriate. These rules are then proposed and filed with the Ohio General Assembly's Joint Committee on Agency Rule Review (JCARR) and other agencies as required by Ohio Revised Code section 119.03.
