Public Notice: Proposed Rulemaking Governing Rules for Primary Drinking Water Standards

 

Notice is hereby given that Ohio Environmental Protection Agency, Division of Drinking and Ground Waters (DDAGW) proposed revisions to rules in chapter 3745-81, Primary Drinking Water Standards of the Ohio Administrative Code (OAC). The proposed amendments are, in part, a result of the five-year rule review requirements of Section 106.03 of the Ohio Revised Code (ORC).

 

Proposed revisions to OAC Rules 3745-81-12, 3745-81-32, and 3745-81-74 include the following:

  • Formatting Corrections within contaminant tables and paragraph lettering
  • Changing “pofublic” to “public” in 3745-81-32 (A)(1)
  • Removal of old rule language referring to deadlines of March 31, 2016
  • Removal of old rule language referring to past starting date of April 1, 2016
  • Addition of language addressing how long a tier 1 notice must remain in effect
  • Addition of language addressing continuous turbidity monitoring if found acceptable by the director

 

The public comment period will run until November 25, 2022. A public hearing on this proposed rulemaking will be held to consider public comments in accordance with Section 119.03 of the Ohio Revised Code. Ohio EPA will be holding a virtual and in-person public hearing on the rules on November 30, 2022, at 10:30 a.m. Stakeholders will be able to comment in-person in DDAGW Conference Room A at Lazarus Government Center, 50 West Town Street, Suite 700, Columbus, Ohio 43215. During the hearing, the public may submit written comments on the record about the proposed rules if participating virtually and verbally if participating in person. Registration for the in-person hearing is not required. Citizens intending to give testimony at the hearing should notify the Ohio EPA Public Interest Center, P.O. Box 1049, Columbus, Ohio 43216-1049, (614) 644-2160 or by emailing mary.mccarron@epa.ohio.gov. Prior registration will ensure that registrants are heard ahead of those individuals who register at the hearing. Oral testimony may be limited to five minutes, depending on the number of persons testifying. All interested persons are entitled to attend or be represented and to present oral and/or written comments concerning the proposed rule making.

 

Comments can be submitted by email to ddagw_rulecomments@epa.ohio.gov. Comments should be received at the above address by close of business, November 30, 2022. In order to ensure that written comments are considered as part of the official record of this hearing, written comments must be received by Ohio EPA by the close of business on November 30, 2022. Written comments on the proposed rules may be given to the presiding officer during the hearing, sent by mail to Rylee Lane at the address above, or sent by email to the following address: ddagw_rulecomments@epa.ohio.gov.
