Rules and Laws Governing the Resource Conservation and Recovery Act

Ohio Revised Code (ORC) Chapter 3734 and Ohio Administrative Code (OAC) Chapters 3745-50 through 57, 65 through 69, 205, 256, 266, 270, 273 and 279 contain the rules for hazardous waste management in Ohio. These rules were developed with input from stakeholders and can be viewed on the Division of Materials and Waste Management’s website.

This Division of Materials and Waste Management (DMWM) page provides information and access to current and pending rules on Ohio’s Resource Conservation and Recovery Act (RCRA)-based Hazardous Waste Management program and Ohio’s Cessation of Regulated Operations (CRO) program. 

The tabs below provide information and the status of specific DMWM rule development activities and opportunities for public input, as well as the status of draft, proposed and effective rules. 

Links to general information, which may be of use to individuals interested in rules or the rule-making process, can be found under the 'Additional information' tab. These sites include the Register of Ohio, which contains all state agency rule proposal packages, and the Joint Committee on Agency Rule Review (JCARR), which is the state legislative committee responsible for the review and processing of all state agency rules.

Cessation of Regulated Operations (CRO) Rules: 

  • Ohio EPA's DMWM has released an Early Stakeholder Outreach (ESO) document for the Cessation of Regulated Operations (CRO) rules. Please see the 'Early Stakeholder Outreach' tab on this page to view the document and for more information. 
  • Early Stakeholder Outreach - Cessation of Regulated Operations (CRO) Rules: The rules addressed by this Early Stakeholder Outreach (ESO) are in the Hazardous Waste Management program and regulated the CRO.These rules are in the Ohio Administrative Code (OAC) Chapter 3745-352. There are nine hazardous waste rules under consideration in this ESO. Comments are due by close of business on Aug. 3, 2015.
  • Early Stakeholder Outreach - Hazardous Waste Program Definition of Solid Waste: DMWM announces the Early Stakeholder Outreach (ESO) comment period beginning May 13, 2015 regarding the hazardous waste rules known as Definition of Solid Waste Rule (DoSW Rule) to be addressed in Ohio rule-making. Note that these are hazardous waste program rules (RCRA Subtitle C) despite the term "solid waste" in the subject. Draft Ohio rules will be available for review in the future; there are no rules to review at this time. Please see the DoSW ESO fact sheet for more information. Comments are due by close of business on Aug. 13, 2015.
