- April 19, 2018: The Division of Drinking and Ground Waters (DDAGW) seeks comments on the proposed rulemaking governing Confidentiality of information rule in Chapter 3745-34 of the Ohio Administrative Code. Comments are due by May 21, 2018. Click here for more information.
- April 12, 2018: Ohio EPA has adopted amended rules governing Primary Drinking Water Standards and the Lead and Copper rules in OAC Chapter 3745-81, Laboratory Certification rule in Chapter 3745-89 and Consumer Confidence rule in Chapter 3745-96 of the Ohio Administrative Code. The revisions were prompted by the passing of Ohio House Bill 512 which became effective in Ohio Revised Code (ORC) § 6109.121, Sept. 9, 2016.
The new rules will be effective as of May 1, 2018 (see Public Notice of Adoption). The rules are being adopted after a draft comment period which ended March 17, 2017, a proposal comment period which ended March 6, 2018 and a public hearing held on March 6, 2018 in Columbus, Ohio.

- Feb. 16, 2018: The Division of Drinking and Ground Waters (DDAGW) seeks comments on the proposed new rule added to Chapter 3745-83 of the Ohio Administrative Code. The proposed rule establishes requirements for public water systems that have a disruption of service involving the distribution system. Comments are due March 19, 2018. - Feb. 16, 2018: The Division of Drinking and Ground Waters (DDAGW) seeks comments on proposed rule revisions to the backflow prevention rules and underground injection control rule to satisfy the five-year rule review requirement of Section 106.03 of the Ohio Revised Code (ORC). - Jan. 3, 2017: DDAGW seeks comments on the draft guidance document, Guidelines for Determining When Source or Treatment Changes Trigger New Optimal Corrosion Control Evaluation. DDAGW's Rule-making Process
The Division of Drinking and Ground Waters (DDAGW) rules were promulgated under U.S. EPA's Safe Drinking Water Act (SDWA). Rules for Ohio public drinking water systems are adopted under Ohio Revised Code (ORC) Section 6109, and rules for Underground Injection Control, under ORC 6111.043. Ohio Administrative Code (OAC) rules administered by DDAGW are located on this page.
Proposing new rules and amendments to existing rules is a regular activity conducted by Ohio EPA in response to laws passed by the General Assembly and federal rule requirements. The Agency is also required by state law to review its rules at least once every five years to ensure their continued need and relevance. During the Ohio rule-making process, rules are in one of four phases: early stakeholder outreach; draft; proposed; and effective. Electronic versions of rules in each of these various phases may be viewed by clicking on the appropriate tabs on this page.
In addition to adopting rules and laws, DDAGW adopts both policies and guidance documents. The purpose of a policy is to clarify and explain specific aspects of regulations (OAC) and law (ORC) so Ohio EPA and external parties have a common understanding of how environmental regulations are carried out in Ohio. Policies promote consistency and provide savings of both technical and administrative staff resources when dealing with the application of rules. Guidance documents provide information, suggestions and recommendations on possible or acceptable methods that may be used to meet or to achieve compliance with rules.

Proposed Rules
Ohio EPA considers comments received during interested party review and makes changes to the rules as appropriate. These rules are then proposed and filed with the Ohio General Assembly's Joint Committee on Agency Rule Review (JCARR) and other agencies as required by Ohio Revised Code section 119.03. Another opportunity for public comment is offered. More information about proposed rules is on the Register of Ohio website.

Proposal of Revised Rules- OAC Chapter 3745-81, Lead and Copper rule
The Division of Drinking and Ground Waters (DDAGW) has proposed revisions to several rules in OAC Chapter 3745-81 (primary drinking standard and lead and copper rule) and OAC rules 3745-89-08 (Laboratory Certification rule) and 3745-96-02 (Consumer Confidence Reports rule) to Joint Committee on Agency Rule Review (JCARR). The revisions incorporate provisions of Ohio House Bill 512 (effective in Ohio Revised Code § 6109.121). These rules address lead notification and monitoring for community water systems and nontransient noncommunity water systems.
Ohio EPA will be holding a public hearing on the revised rules on March 6, 2018, at 10.30 am at Ohio EPA Central office, Columbus, Ohio.
